On October 24, Occupy Wall Street activists Pete Dutro and Victoria Sobel filed an application to trademark the movement’s phrase for a line of clothes, bags, stickers and magazines. But members of the dreaded 1% may have beaten them to it.

Fer-Eng Investments, an Arizona limited liability corporation, is also seeking to secure the catchphrase for commercial purposes. Vincent Ferraro, who is named on the application, is the vice president and chief marketing officer of global marketing for Eastman Kodak, and also holds several consulting positions, American University’s Intellectual Property Brief reported. Unfortunately for Fer-Eng Investments, New York’s Occupy Wall Street applied for their trademark almost three hours earlier, and priority in such cases is usually given to whichever entity files its application first.
